Terms and Conditions of Nicolo Company – Online Shop
1 Applicability to Entrepreneurs and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 German Civil Code).
2 Conclusion of Contract, Storage of Contract Text (1) The following provisions regarding the conclusion of the contract apply to orders through our internet shop http://www.egravur.de.

(3) The presentation of the goods in our internet shop does not constitute a legally binding offer on our part, but is merely an invitation to the consumer to order goods. By placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract. (4) In the case of an order being received in our internet shop, the following provisions apply: The consumer submits a binding contract offer by successfully completing the ordering process provided on our internet shop.
The order process consists of the following steps:
- Selection of the desired goods
- Confirmation by clicking the “Order” button
- Checking the information in the shopping cart
- Clicking the “Checkout” button
- Re-checking or correcting the respective entered data.
- Binding order
(4) Before submitting the binding order, the consumer can return to the webpage where the customer data is recorded by using the “Back” button contained in the internet browser used by the consumer to check their information and correct any input errors, or they can cancel the ordering process by closing the internet browser. We confirm the receipt of the order immediately by means of an automatically generated e-mail (“order confirmation”). With this, we accept your offer.
(5) Storage of the contract text for orders through our internet shop: We will send you the order data and our General Terms and Conditions (GTCs) by e-mail. You can also view the GTCs at any time under https://www.nicolo.de. For security reasons, your order data is no longer accessible via the internet.
3 Prices, Shipping Costs, Payment, Due Date
(1) The prices quoted include the statutory value-added tax and other price components. Any shipping costs will be added.
(2) The consumer has the option of payment in advance or PayPal.
(3) If the consumer chooses payment in advance, they are obliged to pay the purchase price immediately after the contract is concluded.
4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery will be made within a maximum of 2 working days. The deadline for delivery begins on the day after the payment order is given to the bank responsible for the transfer in the case of payment in advance, and on the day after the contract is concluded for all other payment methods. If the deadline falls on a Saturday, Sunday or legal holiday at the place of delivery, the deadline ends on the next working day.
(2) The risk of accidental loss and accidental deterioration of the goods sold passes to the buyer upon handover of the goods.
5 Reservation of Title
We reserve the right to retain ownership of the goods until full payment of the purchase price has been received.
§5a Creation of Names, Logos and Initials by means of Laser Engraving If the goods are engraved by means of laser engraving, any return is excluded.
The customer is responsible for the accuracy of the letters or characters to be engraved.
6 Right of Withdrawal for Consumers: Right of Withdrawal for Consumers
Consumers are entitled to a right of withdrawal as follows, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed:

You have the right to withdraw from this contract within fourteen days without giving any reason.
The right of withdrawal pursuant to §312 d para. 4 of the German Civil Code (BGB) does not exist if the goods have been made according to customer specifications (e.g. engraving).
The withdrawal period shall be fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
We may withhold the reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods.
